The superhosts website is owned, published and operated by Antoine Kim Cheang (sole trader) (SIRET: 81538741000039), registered at 64 Rue de Romainville, 93100 Montreuil, France. We are available Monday to Friday from 9am to 6pm at: antoine@superhosts.io

Use of the superhosts website is subject to acceptance of these General Terms of Use (GTU). By accessing superhosts, you unconditionally accept these GTU in their most recent version available on the site. In the event of non-compliance, superhosts reserves the right to restrict or prohibit access to the site.

superhosts is a platform connecting property owners, professional concierges and cleaning contractors. Our service allows owners to find qualified concierges and contractors for the management of their short-term rentals.

superhosts acts solely as a technical intermediary enabling connections. The platform does not guarantee payment of services, the accuracy of information published by users, or the quality of services provided.

superhosts services are reserved for adult individuals legally capable of entering into contracts, as well as duly represented legal entities. Upon registration, each user undertakes to provide accurate, sincere and up-to-date information, create only one user account, and maintain the confidentiality of their login credentials.

Access to certain features is subject to a paid subscription. Rates and terms are available on the Pricing.

The following are strictly prohibited on the platform:

• Publishing false, misleading or fraudulent information
• Impersonating a third party or falsely presenting oneself as a certified professional
• Bypassing the connection system (exchanging contact details outside the platform before collaboration is accepted)
• Sending unsolicited commercial messages (spam)
• Harassing, threatening or intimidating other users
• Publishing unlawful, offensive, discriminatory content or content infringing third-party rights
• Using automated means (bots, scrapers) to access the platform
• Creating multiple accounts to circumvent a suspension

Any content or behaviour of a sexual, romantic or flirtatious nature towards other users of the platform is also prohibited. superhosts is a professional platform exclusively dedicated to connecting parties for concierge services.

Failure to comply with these rules results in the immediate suspension or deletion of the account, without notice or compensation. superhosts reserves the right to remove any content, profile or account that violates these rules, at its sole discretion and without having to justify its decision.

Concierges and contractors may publish their profile on the platform. Each profile must contain truthful and accurate information, precisely describe the services offered, clearly indicate the geographic areas covered, and specify the rates applied.

superhosts reserves the right to refuse or remove any profile or content that does not comply with these GTU, without notice and without giving rise to any compensation.

superhosts reserves the right to suspend or delete any user account in the following cases, without notice or compensation:

• Failure to comply with these GTU
• Providing false information upon registration
• Fraudulent, abusive or harmful behaviour towards other users
• Publishing or sending inappropriate, offensive, sexual or flirtatious content
• Non-payment of subscription after formal notice
• Account inactivity for more than 30 days: any account with no login activity for 30 consecutive days may be automatically unpublished. A notification email will be sent to the registered address before any permanent deletion of data.

The user may delete their own account at any time from their personal space or by requesting deletion at antoine@superhosts.io. Account deletion results in the permanent deletion of all associated data within 30 days.

By publishing content on superhosts (photos, descriptions, reviews, etc.), the user grants Antoine Kim Cheang (sole trader) a non-exclusive, worldwide, royalty-free licence to use, reproduce, display and distribute such content for the purposes of operating the platform.

The user warrants that they hold all necessary rights to the content they publish and that it does not infringe third-party rights (copyright, image rights, etc.). superhosts cannot be held liable for user-published content.

Users' contact details (phone, email, address) are never shared with other users until a collaboration has been accepted by both parties. Once a collaboration is accepted, both parties' contact details are exchanged to enable its organisation.

Access to the platform requires a paid subscription for concierges. Property owners and cleaning providers have free access. Concierges receive a free trial period of 3 months on subscription: a payment card is required at signup and, at the end of that period, the subscription is charged automatically at the current rate unless cancelled beforehand. The applicable trial period is the one in force on the subscription date; any subsequent change to that duration has no effect on trial periods already underway. Financial transactions relating to services are carried out directly between the parties, outside the platform. superhosts does not intervene in these transactions and does not take any commission on services.

After a collaboration, users may evaluate each other. Only users who have actually collaborated may leave a review. Reviews must be honest, constructive and respectful. superhosts reserves the right to moderate and remove any review not complying with these GTU, without notice.

superhosts reserves the right to read messages exchanged on the platform for fraud prevention, service improvement, user assistance and GTU compliance verification.

To prevent the connection system from being bypassed, we analyse messages to ensure they do not contain contact details (email, phone, address) before the connection is established.

superhosts acts solely as a technical intermediary and accepts no liability for:

• The quality, compliance or performance of services
• Disputes between owners, concierges and contractors
• Damage to property or persons in the context of services
• Non-payment of services between users
• The accuracy of information provided by users
• Technical interruptions or malfunctions of the platform
• Data loss due to technical failure

In any event, superhosts' liability is limited to the amounts actually received by superhosts from the relevant user over the previous 12 months.

By registering on superhosts as a concierge or contractor, the user solemnly declares that they carry out their activity in compliance with applicable French law, and in particular:

• Being registered as a professional (sole trader, company or other legal status)
• Being up to date with tax and social security obligations
• Holding the professional insurances necessary for their activity (professional liability insurance in particular)

superhosts accepts no liability in the event of illegal activity by a user. In the event of false declaration, the account will be immediately deleted and superhosts reserves the right to take legal action.

Any user may report inappropriate behaviour, unlawful content or a violation of these GTU by sending an email to antoine@superhosts.io.

superhosts undertakes to process each report within a reasonable time and take appropriate measures. A report does not automatically result in the deletion of the reported content or account.

Subscriptions are taken out on a monthly basis and automatically renew at each billing date, unless cancelled before the renewal date.

To cancel a subscription, the user must submit a request from their personal space or by email to antoine@superhosts.io at least 7 days before the renewal date. Cancellation takes effect at the end of the current monthly period, with no pro-rata refund.

In the event of a serious breach of these GTU, superhosts reserves the right to cancel the subscription with immediate effect, without refund for the current period.

superhosts shall not be held liable for the non-performance or delay in performance of its obligations in the event of a force majeure event within the meaning of Article 1218 of the Civil Code, including natural disasters, network outages, cyberattacks, or any unforeseeable governmental decision.

All platform content (texts, images, logos, design, source code) is protected by copyright and belongs to Antoine Kim Cheang (sole trader) or its partners. Any reproduction, representation or exploitation without prior written authorisation is prohibited.

superhosts reserves the right to amend these GTU at any time. Users will be informed of any material change by email to the address registered upon sign-up, with a minimum of 15 days' notice before the change takes effect. Continued use of the platform after an amendment constitutes acceptance of the new terms.

In accordance with Article L.221-18 of the Consumer Code, the consumer has fourteen days to exercise their right of withdrawal from a distance contract, without having to justify their decision. To exercise this right, send an email to antoine@superhosts.io with the subject 'Right of withdrawal'.

superhosts attaches great importance to the protection of your personal data. For all information regarding the collection, processing and protection of your data, please consult our Privacy Policy.

These GTU are governed by French law. In the event of a dispute, the parties will endeavour to resolve it amicably. Failing an amicable agreement, the dispute will be submitted to the exclusive jurisdiction of the Paris courts.

In accordance with Articles L.611-1 et seq. of the Consumer Code, for any unresolved contractual dispute, you may use free mediation by contacting the Association Nationale des Médiateurs (ANM), 62 rue Tiquetonne, 75002 Paris, via www.anm-conso.com.

In the event of a transfer, merger or acquisition of Antoine Kim Cheang (sole trader), these GTU and user data may be transferred to the acquirer, who will be bound to comply with them. Users will be informed by email within a reasonable time.

The user may not transfer their rights and obligations under these GTU to a third party without the prior written consent of superhosts.

If any clause of these GTU is declared null or unenforceable by a court decision, the remaining clauses shall remain fully in force. The null clause shall be replaced by the clause most closely reflecting the original intention of the parties.
